Agreement to Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between Creators Everywhere ("we", "us", "our") and you ("User", "you") concerning your access to and use of the website https://creatorseverywhere.com/ and any related services, products, or content offered by Creators Everywhere (collectively, the "Service").

By accessing or using the Service, creating an account, placing an order, or otherwise engaging with Creators Everywhere, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be legally bound by them. If you do not agree to these Terms, you must immediately stop using the Service.

Creators Everywhere reserves the right to suspend or terminate your account at any time if we reasonably believe that account information is inaccurate, that the account has been used in violation of these Terms, or for any other reason at our sole discretion with or without prior notice.

You may not create more than one account per person, create accounts for others without their consent, or create an account using a false identity or another person's information. Accounts are non-transferable and may not be sold, shared, or assigned to another party.

Payments and Pricing

Certain features of the Service require payment. By making a purchase, you agree to pay all applicable fees as described at the time of purchase. All prices are displayed in [Your Currency] and are inclusive/exclusive of applicable taxes as indicated at checkout.

Creators Everywhere reserves the right to change prices at any time. Price changes will not affect orders already confirmed unless expressly stated. FTC Compliance: All pricing, charges, and billing practices comply with applicable FTC regulations including the Restore Online Shoppers' Confidence Act (ROSCA) requirements for clear disclosure of material terms before charging.

Subscriptions and Automatic Renewal

Some features of the Service are offered on a subscription basis. By subscribing, you agree to the following:

• Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You authorise us to charge your payment method on file for each renewal period at the then-current subscription price.
• Renewal Notice: We will provide advance notice of any price changes affecting your subscription before the renewal date, giving you the opportunity to cancel before being charged the new rate.

• Trial Periods: Where a free trial is offered, you will not be charged during the trial. Unless you cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.

ROSCA Compliance: Negative option features (auto-renewal) are disclosed clearly in accordance with the FTC's Negative Option Rule. You will receive clear notice of the subscription terms, price, and cancellation mechanism before any charge is made.

Refunds and Cancellation Policy

Our refund policy is as follows:

• Digital products and downloads: Due to the nature of digital products, all sales are final once the product has been accessed or downloaded, unless the product is defective or materially different from its description.
• Subscription cancellations: Subscriptions cancelled mid-period are not eligible for a pro-rated refund of the remaining subscription period unless required by applicable law in your jurisdiction.

User-Generated Content

The Service may allow you to submit, post, upload, or otherwise contribute content including text, images, reviews, comments, or other material ("User Content"). By submitting User Content, you agree to the following:

• Licence to Creators Everywhere: You grant Creators Everywhere a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business operations, including for promotional purposes.
• Ownership: You retain ownership of your User Content. The licence above does not transfer ownership to us.
• Representations: You represent and warrant that you own or have the necessary rights to submit the User Content and that doing so does not infringe any third-party intellectual property, privacy, or other rights.
• Prohibited Content: User Content must not be illegal, defamatory, harassing, obscene, infringing, or otherwise objectionable. We reserve the right to remove any User Content at our sole discretion without notice.

Creators Everywhere does not endorse, verify, or take responsibility for User Content. Users are solely responsible for their submissions. You indemnify Creators Everywhere against any claims arising from your User Content.

Under the GDPR, if your User Content contains personal data about third parties, you are responsible for ensuring you have a lawful basis to share that data and that it complies with applicable data protection law.

Intellectual Property

All content on the Service that is not User Content — including but not limited to text, graphics, logos, images, audio clips, video, software, data compilations, and the overall design and arrangement of the Service — is owned by or licensed to Creators Everywhere and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose as described in these Terms. This licence does not include:

• Copying, reproducing, or distributing any part of the Service for commercial purposes
• Modifying, adapting, or creating derivative works based on the Service or its Content

The Creators Everywhere name, logo, and any associated marks are trademarks of Creators Everywhere. You may not use our trademarks without our prior written consent.

• Legal or regulatory requirements

Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and dispute resolution clauses — shall survive.

Termination does not entitle you to a refund of any fees paid, except where a refund is expressly required under our Refund Policy or applicable law.

• Warranties that the Service will be uninterrupted, error-free, or free of viruses or other harmful components
• Warranties regarding the accuracy, completeness, reliability, or timeliness of any content or information on the Service
• Warranties that defects will be corrected or that the Service or the servers that make it available are free of harmful components

No advice or information, whether oral or written, obtained by you from Creators Everywhere or through the Service shall create any warranty not expressly stated in these Terms.

Limitation of Liability

• No Partnership: Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and Creators Everywhere.
